UPDATE: Planned COSATU mass action - 5th Oct 2011

Please take note of the following updated extract, regarding the planned COSATU mass-action:

Members of the RFA/RFEA take note of the following communique –

UPDATE REGARDING COSATU MASS ACTION— 5 OCTOBER 2011

The RFA has just received the following information from BUSA pertaining to the intended mass action by
COSATU-affiliated unions, on 5th October:
·         The intended action is linked to the draft labour bills , specifically in terms of COSATU’s demand that a ban
should be placed on labour broker employment
·         According to BUSA the process of engagement on this matter at NEDLAC is still ongoing and no formal
dispute has been declared in this regard
·         BUSA confirms that subsequent to COSATU issuing a section 77 (1) (d) notice of their intended action on 5th
October, NEDLAC’s section 77 standing committee confirmed at a meeting that the notice was premature in
that it dealt with matters which were being addressed at NEDLAC through an existing process
·         BUSA has addressed urgent correspondence to COSATU in this regard and is expecting to meet with COSATU
leadership this afternoon, after which we will receive further communication
·         BUSA thus advises as follows:
·         They deem any participation in such protest action on 5th October to be unprotected since provisions of
section 77 of the LRA have not been complied with
·         Employers may therefore apply the “no work no pay” rule for all employees participating in such action
·         Employers should reserve the right to take disciplinary action against workers who participate in same
action
Also note that the RFA has received various reports that the protest action may have been postponed
Indefinitely, and they await confirmation of same from BUSA and will advise members accordingly.
